Having been retained by the project owner, we were charged to work with the contractor's consultant to develop a basis for entitlement for a differing site condition claim. The claim was for rock harder than anticipated. Unfortunately for the contractor, it was not possible because the contractor's records were inadequate to establish entitlement.
